GENERAL TERMS AND CONDITIONS

The products sold on store.virtus.it are distributed by FANATICS ITALY S.R.L.
Trademarks, logos, and other distinctive marks of various kinds on the site belong to their respective owners.
The use of trademarks, logos, and other distinctive signs, including reproduction on other websites by unauthorized third parties, is prohibited.
The content on the site (texts, graphics, images, and animations) is protected by copyright; thus, reproducing or publishing images in any form without the written permission of FANATICS ITALY is prohibited.
Each purchase of goods through the site is subject to the following:
Article 1 - DEFINITIONS
1.1. “Site” refers to the store.virtus.it website, dedicated to the sale of official Virtus Pallacanestro Bologna S.P.A. merchandise.
1.2. “Customer” refers to the individual (natural or legal person) making the purchase on the Site, agreeing to the general terms of sale.
1.3. “FANATICS ITALY” refers to FANATICS ITALY S.R.L., headquartered at Via Magistretti, 10 – 20128 Milan, a company registered with the Chamber of Commerce of Milan under No. 359848 in the Business Register - Tax Code – VAT No. 11670080156. FANATICS ITALY is the official e-commerce provider of Virtus Pallacanestro Bologna S.P.A.
1.4. “Order” refers to the product request form completed by the Customer via the Site.
1.5. “Products” are the goods for sale on the Site, under the general terms of sale.
1.6. “Customized Products” are goods personalized upon the Customer's specific request and instructions.
1.7. “Price” refers to the sale price of the goods only.
1.8. “Contract” refers to the remote contract for the sale of products, based on the general terms of sale.
1.9. “Parties” refers to FANATICS ITALY and the Customer.
Article 2 - PROCEDURES FOR CONTRACT CONCLUSION
2.1. The products are offered for sale according to the terms and conditions set forth in the contract published on the site at the time of order.
2.2. To make a purchase, the Customer must follow these steps:
- I) Select the product and click “add to cart”: the main product features and the total price, including shipping (excluding any applicable customs duties), will then appear;
- II) Click “proceed to checkout” and fill out the request form (“Order”), specifying the preferred payment method; before proceeding to the next stage, the Customer must verify the accuracy of the entered data, for which they are responsible;
- III) Read the general contract conditions by clicking the respective button and accept them by checking the box next to “I accept the terms and conditions of sale”;
- IV) Click “purchase”: this button will indicate, as required by law, that placing the order entails the obligation to pay for the goods being purchased.
2.3. After this, the Customer will receive an order confirmation detailing the ordered product types, the price of each item, delivery charges, chosen payment method, and a note on the right of withdrawal per article 8 below, exercisable under certain conditions.
2.4. The contract is considered concluded and binding once FANATICS ITALY sends the order confirmation to the Customer's email address.
2.5. The contract will be stored, and the Customer may view it by accessing their personal area or contacting Customer Care.
2.6. The production and supply of customized products sold through the site require a specific request by the Customer, to be made following the site’s instructions. Purchasing these products requires prepayment, and the right of withdrawal from the purchase contract is excluded.
2.7. The contract may also be concluded in English, in addition to Italian.
Article 3 - DELIVERY TIMES AND METHODS
3.1. Delivery of products to the shipping address provided by the Customer in the order is done via express courier.
3.2. Delivery times: 24-48 hours within Italy, 48-72 hours within Europe, and 3 or more business days for non-European countries, starting 24 hours after FANATICS ITALY receives the order. These times are approximate and not strictly binding for FANATICS ITALY. In any case, delivery will occur within thirty days from the contract conclusion date at the latest.
3.3. In the event of non-delivery within the agreed period or within thirty days, the Customer must ask FANATICS ITALY to deliver within an additional reasonable timeframe and is entitled to terminate the contract only if the additional period expires without delivery.
3.4. If one or more products become unavailable after the order confirmation, FANATICS ITALY will notify the Customer via email, although the remaining products will still be shipped. In this case, the contract remains valid for the shipped products only, and the Customer may not refuse partial delivery or payment for the delivered goods but may only receive a refund for the unavailable product(s), if already paid.
Article 4 - REGISTRATION
4.1. It is not necessary to register in advance to purchase products. However, the user may choose to register: registration is free, quick, and does not entail any purchase obligation. Upon placing the first order, the Customer will be automatically registered and receive a generic password, which they can immediately change through the confirmation email link. The Customer agrees to provide correct, truthful, and complete information regarding personal details, contact information, and other information needed for order fulfillment.
4.2. The Customer must keep a copy of the purchase confirmation sent by store.virtus.it to the email address provided during site registration.
Art. 5 - PRICE, PAYMENT, AND INVOICE
5.1. Prices are expressed in Euros (€) and include the applicable Value Added Tax (VAT) for the relevant product categories.
5.2. The total price at the end of the order includes shipping costs but does not cover any customs duties and/or additional sales taxes required for the importation of goods into foreign countries. Any extra charges for customs clearance will be solely the responsibility of the shipment’s recipient.
5.3. Payment of the price must be made:
- at the time of placing the order for advance payments with a credit card or PayPal.
5.4. The invoicing request must be made at the time of the order by selecting the appropriate checkbox during checkout.
For orders with Scalapay, you receive your order immediately and pay in 3 installments. You acknowledge that the installments will be assigned to Incremento SPV S.r.l., its affiliates, and assignees, and you authorize this assignment.
Art. 6 - FORCE MAJEURE
6.1. If the contract cannot be executed, even in part, due to product unavailability or other force majeure reasons, FANATICS ITALY will notify the Customer via email within thirty days from the order’s submission date and will be released from all obligations, except for reimbursing any amounts already paid by the customer.
Art. 7 - COPYRIGHT AND TRADEMARKS
7.1. The contract does not grant the Customer any rights over trademarks, logos, and other distinctive signs of various kinds on the website, nor on the related content.
Art. 8 - RIGHT OF WITHDRAWAL
8.1. According to Articles 52 and following of Legislative Decree No. 21/2014, the consumer customer has the right to withdraw from the contract without penalties and without specifying any reason within fourteen days from receipt of the goods (or, in the case of multiple goods ordered with a single order and delivered separately, from the day the Customer or a third party designated by the Customer, different from the carrier, acquires physical possession of the last good).
8.2. To exercise the right of withdrawal, the Customer must, before the expiry of the period mentioned above, inform FANATICS ITALY of their decision: a) by sending written communication via post or email (storecustomercare@virtus.it).
8.3. In case of withdrawal, the Customer is required to return the goods received to FANATICS ITALY, delivering them to FANATICS ITALY S.R.L. - Via Morelli, 1 – 20054 Segrate (MI) - Italy, without undue delay and in any event within fourteen days following the date of the withdrawal notice. The deadline is considered met if the Customer returns the goods before the end of the fourteen-day period.
8.4. The direct cost of returning the goods, including any customs duties, is the Customer’s responsibility. The refund excludes transport costs for both sending and returning the goods, as well as any customs duties/taxes.
8.5. The Customer must return the goods in an intact state and with the original labels not removed. Product packaging must be careful to protect the original packaging from damage, writing, or labels. The consumer is responsible for any decrease in value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
8.6. If the right of withdrawal has been exercised in compliance with the above provisions, FANATICS ITALY will refund all payments received, within thirty days of receiving the withdrawal notification, using the same payment method used by the Customer for the initial transaction, provided that this does not incur any additional refund-related costs for the Customer. However, in accordance with Article 56, paragraph III, of Legislative Decree No. 21/2014, FANATICS ITALY reserves the right to withhold the refund until it has received the goods or until the Customer provides proof of having returned the goods, whichever occurs first.
8.7. The right of withdrawal applies only to individuals acting for purposes unrelated to any business, commercial, craft, or professional activity. Therefore, resellers and companies are excluded from the right of withdrawal.
8.8. The right of withdrawal is also excluded, as per Article 59 of Legislative Decree No. 21/2014, in the case of customized goods (see previous Article 2.6.), as well as sealed goods that are unsuitable for return for health protection or hygiene reasons and have been unsealed after delivery.
8.9. No refunds are available on customized products upon the customer’s specific request (e.g., products customized with player names/numbers or personal initials, patches, except for defective or damaged products); on underwear, swimwear, and face masks; or on jerseys due to a player’s number change or transfer to another team. No refunds are issued for discounted products (Outlet section, special promotions).
Art. 9 - CUSTOMER RIGHTS IN CASE OF NON-CONFORMING PRODUCTS
9.1. If the Customer detects a product defect and is a consumer, they may request a refund. Contract termination/refund is excluded in case of minor defects.
9.2. Following the report, FANATICS ITALY will collect the product from the Customer within a reasonable period and, after verifying the defect, issue a partial or full refund; however, FANATICS ITALY reserves the right to offer alternative remedies, such as a voucher of equivalent value, to be used by contacting Customer Service. If the Customer accepts, FANATICS ITALY will proceed with the specific proposed remedy.
Art. 10 - PRIVACY
10.1. Data provided by the Customer necessary for contract fulfillment is processed according to Legislative Decree 2003 No. 196 regarding Personal Data Protection. For more information, the Customer can consult the Privacy section on this website.
Art. 11 - COMMUNICATIONS
11.1. All communications between the parties must be in writing and sent to the address of the other party as indicated. For FANATICS ITALY, this is specified in these contract terms, and for the Customer, in the order sent.
11.2. Communications sent to the other party’s email address, as indicated above, are also considered valid written communications.
Art. 12 - APPLICABLE LAW AND JURISDICTION
12.1. The parties, by signing the contract under the terms of Article 2, agree that it is governed by Italian law and subject to Italian jurisdiction, with the explicit exclusion of the application of the United Nations Convention on Contracts for the International Sale of Goods.
12.2. For any disputes regarding the contract’s validity, execution, or interpretation, the competent jurisdiction will be: a) the Customer’s place of residence or domicile if the Customer is a consumer and resides or is domiciled in Italy; b) the exclusive jurisdiction of the Court of Milan in all other cases.
12.3. The Customer may also use mediation procedures as per Legislative Decree 28/2010 to resolve disputes related to the interpretation and execution of these sales conditions by visiting: https://webgate.ec.europa.eu/odr.
